Compliance requirements

The bidder must not be subject to exclusion grounds, including a final conviction for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or human trafficking. The checks also cover tax and social security arrears, serious or repeated breaches of previous public contracts, enabling the employment of an unlawfully residing foreign national, risks related to international sanctions and lack of the right to participate in the procurement. The bidder must provide the relevant declarations in the ESPD and, where applicable, information describing the breach and any measures taken to restore its reliability. The names and personal identification codes of authorised persons not visible in the commercial register must also be provided, or the bidder must confirm that no such persons exist.

Qualification criteria and exclusion grounds

The bidder’s net turnover for the latest financial year completed by the start of the procurement must be at least EUR 30,000. Joint bidders may combine their turnover figures. At the contracting authority’s request, an extract from the annual report or another document proving the turnover must be submitted if the information is not publicly available. If the bidder relies on another entity’s resources, that entity’s ESPD and the required consent must be provided; the entity whose turnover is relied upon is jointly and severally liable with the bidder for the relevant part of the contract. Within the 60 months preceding the start of the procurement, the bidder must have properly completed at least one public-road construction contract involving the installation of at least 800 m² of the upper asphalt-concrete pavement layer. At the contracting authority’s request, the bidder must submit confirmation from the client stating the works performed, the completion period, the installed pavement-layer quantity and proper completion of the contract. If another entity’s technical and professional capacity is relied upon, that entity must participate directly in contract performance at least to the extent of the relied-upon capacity. The tender must comply with the procurement documents. All payment-item price fields in the HD IV price schedule must be completed, and the list of items, names, work descriptions, parameters, units of measurement and quantities may not be changed or deleted. Prices must be stated in euros to two decimal places, and the fully completed price schedule must be submitted as an MS Excel file. Any trade secret must be identified and justified where applicable. For a joint tender, separate ESPDs for all joint bidders and a power of attorney must be submitted. The bidder must confirm that the offered goods are not subject to international sanctions and do not originate from a sanctioned region.
