Compliance requirements

A bidder will be excluded if the bidder or persons representing, deciding for or controlling the bidder are subject to any ground specified in subsection 95(1) of the Estonian Public Procurement Act. The declarations cover, among other matters, participation in a criminal organisation, corruption, fraud, terrorism or terrorist financing, money laundering, enabling illegal employment, illegal use of child labour and human trafficking. The bidder must have no outstanding state tax, duty or environmental charge debt, and contract award must not breach applicable sanctions. Where a foreign company, consortium member or relied-on entity is involved, evidence of the absence of exclusion grounds must be submitted for the company and relevant representatives when requested or required. The bidder may not use subcontractors or suppliers for more than 10% of the contract value if they are subject to ownership, establishment, residence or control restrictions connected with Russia. The bidder must identify any trade secret and justify that designation; the tender price and figures characterising the tender for evaluation purposes may not be designated as trade secrets.

Qualification criteria and exclusion grounds

The bidder’s net turnover for the last three financial years completed by the date on which the procurement was launched must total at least EUR 600,000, with at least EUR 200,000 in each year. The annual accounts, or copies of the accounts, for the last three completed and approved financial years must be submitted where the information is not available from public registers. If relying on another entity’s capacity, the bidder must provide a signed statement from that entity confirming the absence of exclusion grounds, consent to the reliance, its participation in contract performance and joint responsibility for proper performance. A foreign company must provide extracts from its annual accounts or other documents enabling compliance with the requirement to be verified. The tender must include a technical description of the proposed accessories, including the manufacturer and technical data, a specific manufacturer-issued document or technical data sheet for each device, and a completed price table. Manufacturer website links may not be used as evidence. The equipment must be new, unused, defect-free and compliant with the technical requirements in the tender documents. If the tender is submitted by an authorised representative, a power of attorney must be provided; in a joint tender, the consortium power of attorney and confirmation must be submitted, and the consortium members are jointly and severally liable for contract performance. The bidder must confirm that it has reviewed and accepted the tender conditions and holds the intellectual property and personal-data-processing rights required for participation and contract performance. If an equivalent solution is offered, its equivalence must be explained and supported by evidence. The proposed goods must not be subject to international sanctions or originate from a sanctioned region.
