Compliance requirements

The bidder is excluded if the bidder, a member of its management body or another representative connected with the procurement has been convicted of participation in a criminal organisation, corruption, fraud, a terrorist offence, money laundering or terrorist financing. Exclusion also applies if the bidder or a related person has been convicted of enabling work for a foreign national staying in the country without a legal basis, or of illegal use of child labour or another form of human trafficking. In addition, the bidder is excluded if it has tax, fee or environmental charge arrears, or tax or social security contribution arrears under the law of its country of establishment. For tax arrears, the notice states that debt below EUR 100 or deferred debt is not treated in the same way as ordinary tax debt.

Qualification criteria and exclusion grounds

Within the 36 months preceding the start of the procurement, the bidder must have completed at least two catering service contracts with a value of at least EUR 50,000 excluding VAT. The contracts count from August 2023 until the deadline for publication of the contract notice. The bidder must provide the value of each contract, the date of conclusion and information about the other contracting parties; for public procurements, the reference number must be stated. When submitting the bid, the bidder must confirm that the bid complies with the procurement documents and the technical specification, and that the bid remains valid for at least 90 calendar days from the bid submission deadline. The bidder must also confirm that during the contract period at least 51% of the raw materials used each month for school meals will come from organic production, and that such raw materials are supplied by producers or processors holding the required organic certificate and are sourced from registered organic producers or processors for the relevant product group.
