Compliance requirements

The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurists, representatives or controlling persons have received a final conviction during the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or offences involving child labour or human trafficking. Compliance with tax and social security payment obligations is also checked. The bidder must not be bankrupt, in liquidation or otherwise insolvent, and its business activities must not be suspended. There must also be no breaches of environmental, social or labour law, serious professional misconduct, anti-competitive agreements, conflicts of interest or unjustified involvement in preparing the procurement. The grounds also cover significant or repeated breaches of previous public contracts, false statements, failure to provide required information or documents, and improper attempts to influence the contracting authority’s decision-making. Under Estonian law, the contracting authority additionally checks whether the bidder has enabled the employment of a foreign national without a lawful basis, has complied with international sanctions and has been convicted of tax offences. Where permitted by the tender documents, a bidder affected by an exclusion ground may submit evidence of measures taken to restore its reliability.
