Summary

Compliance requirements

The bidder must confirm that none of the exclusion grounds listed in the ESPD apply to the company, its management or supervisory board members, representatives, or other persons with control or representation powers. These grounds include, among other matters, final convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, and offences involving child labour or human trafficking. The tender also checks payment of taxes and social security contributions, bankruptcy, insolvency or liquidation proceedings, suspended business activity, serious professional misconduct, anti-competitive agreements, conflicts of interest, serious breaches of previous contracts, and the submission of false information or failure to provide required documents. National grounds also include enabling an unlawfully staying foreign national to work, being subject to an international sanction, and convictions for tax offences. The threshold for tax and social security debt is EUR 0; in Estonia, the tax authority does not issue a debt certificate where the debt is below EUR 100 or payment has been deferred. Where an exclusion ground exists, the bidder may describe remedial measures demonstrating restored reliability if that possibility applies.

Qualification criteria and exclusion grounds

The bidder’s net turnover in each of the last three financial years completed before the start of the procurement must be: - at least EUR 100,000 for each year for Lots 1 and 2; - at least EUR 50,000 for each year for Lots 3, 4 and 5. Previous experience must meet the following requirements: - Lot 1: at least one properly completed contract or order for the sale and/or maintenance or repair of motor drills during the previous 36 months, with an aggregate value of at least EUR 10,000 excluding VAT; - Lot 2: at least two properly completed contracts or orders for the sale of chainsaw sets and other garden equipment during the previous 36 months, each worth at least EUR 10,000 excluding VAT; - Lots 3, 4 and 5: at least three properly completed contracts or orders for garden equipment maintenance and repair during the previous 36 months, each worth at least EUR 100 excluding VAT. Turnover data must be provided in the ESPD. Experience must be evidenced by descriptions of the contracts or orders, their values and dates, and the details of the clients. If the bidder relies on another entity, including a subcontractor, it must submit that entity’s ESPD, confirmation that no exclusion grounds apply and that the relevant qualification is met, and a signed undertaking describing the entity’s role and joint responsibility. The contracting authority accepts documents only in Estonian or English. The compliance requirements include the following: Lot 1 requires at least one physical shop or service point in Estonia; Lot 2 requires a functioning online shop meeting the stated requirements; Lot 3 requires at least one physical shop or service point in Harju County; Lot 4 requires at least one in Lääne-Viru or Ida-Viru County; and Lot 5 requires at least one in Tartu or Võru County. The relevant locations or online-shop address must be provided in the tender form for the lot. The tender must follow the required pricing structure and include the relevant Annex 2 tender form. Conditional tenders and prohibited cross-subsidisation are not allowed. Where applicable, equivalence must be explained and supported with evidence.
