Purchase and rental of desktop computers and monitors under a framework agreement (mini-competitions)

The bidder must confirm that neither the company nor its relevant representatives are subject to exclusion grounds, including final convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or other forms of trafficking in human beings. The grounds also cover tax or social security payment arrears, bankruptcy or insolvency proceedings, liquidation, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement, serious failures under previous public contracts, false or misleading information, failure to provide required information or documents, and breaches of environmental, social or labour law obligations. National grounds additionally concern unlawful employment of foreign nationals, international sanctions and convictions for tax offences. The bidder must provide the required declarations and, where relevant, details and evidence concerning the circumstances and any measures taken to restore reliability. The tax information states that a tax debt certificate is not issued where the total debt managed by the tax authority is below EUR 100 or payment has been rescheduled, subject to the applicable rules.

The notice does not set out specific financial capacity, turnover, prior experience or personnel requirements. The bidder must nevertheless meet the stated compliance requirements and submit the required evidence and documents. The offer must include complete manufacturer specifications for the proposed desktop computers, and software specifications where available. If the manufacturer allows different configurations, the exact proposed configuration must be clearly identified and its compliance must be verifiable. A completed compliance table using Annex 5 must be submitted. For purchases, desktop computers and monitors must have a 36-month warranty; mini-competitions may specify a different warranty period, while rental warranty runs from acceptance by the contracting authority until return to the contractor. The warranty must cover repairs, a replacement product during repair, battery defects where applicable, and compliance with the contract without additional charges. The bidder must declare REACH candidate-list substances exceeding 0.1% by mass in the product and specified accessories, or provide evidence that none are present. The bidder must offer reuse and recycling services compliant with Directive 2012/19/EU and provide either evidence of membership in a producer responsibility organisation, evidence concerning an authorised waste-treatment partner, or an environmental permit for self-managed treatment. The offer must describe collection, confidential handling and deletion of data carriers, and dismantling for recycling or disposal. The bidder must identify and justify any trade secrets, confirm equivalence where applicable, and provide a power of attorney for joint bidders where relevant. The bidder must also confirm compliance with the restrictions on Russian-linked subcontractors and suppliers exceeding 10% of the contract value and confirm that the offered goods are not subject to international sanctions or sourced from sanctioned territories.
