A bidder may be excluded, among other reasons, if the bidder or its representatives have received a final conviction within the previous five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour and human trafficking. Grounds for exclusion may also include breaches of tax or social security payment obligations, bankruptcy or insolvency, liquidation, suspended business activities, serious professional misconduct, anti-competitive agreements, an unavoidable conflict of interest, serious breaches of previous public contracts, false information or failure to submit required documents, and improper influence on the procurement procedure. National grounds are also checked, including convictions for enabling unlawful employment or tax offences and the application of international sanctions. The bidder must confirm proper payment of taxes and social security contributions and provide the information required in the ESPD. Where an exclusion ground applies, remedial measures demonstrating restored reliability may be submitted in certain cases.

The bidder must have supplied and installed at least one refrigeration unit similar to the subject of the contract during the previous three years. The ESPD must include the reference supply details, including the client’s name, the contract completion date, the contract value and the contact person’s details. The input does not specify an exact turnover, staffing, professional certificate or additional financial capacity requirement. The bidder must visit the site before submitting the tender and provide a digitally signed confirmation from the construction project manager. The tender must comply with all tender documents and must be unconditional. The tender price must be submitted according to the prescribed evaluation structure. The offered goods must not be subject to international sanctions or originate from a sanctioned region. In a joint tender, a power of attorney for the joint tenderers must be included.
