Mandatory exclusion grounds: the bidder is excluded if it, or a member of its administrative, management or supervisory body, its procurator or another person authorised to represent or control it, has been convicted of participation in a criminal organisation, breach of integrity duties, corruption, fraud, a terrorist act, a terrorism-related offence, money laundering or financing of terrorism; if there is a conviction for enabling the employment of a foreign national staying in the country without legal basis or for violating the conditions for employing a foreign national in Estonia, for illegal use of child labour or human trafficking; or if the bidder has tax, fee or environmental charge arrears, or tax or social security contribution arrears under the law of its country of establishment. Voluntary exclusion grounds: the contracting authority may exclude a bidder if it has seriously or repeatedly breached essential terms of a previous public contract so that the contract was withdrawn from, terminated, price-reduced, damages paid or a contractual penalty paid, or if it has provided false information about compliance with the selection criteria or failed to submit the required data and additional documents. The bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus.

Within the 60 months before the start of the procurement, the bidder must have properly performed at least three contracts for electrical construction works similar to the subject of the contract, and at least one of them must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, details of the other contracting parties (including the client representative’s contact details, telephone number and email address) and, in public procurement cases, the reference numbers. On the contracting authority’s request, evidence of proper performance of the similar electrical construction contracts must be provided, unless the authority can obtain the information from public or private databases without significant cost. In addition, the bidder must have a person leading electrical works with valid A-level competence or, under the Vocational Education Act, a qualification corresponding to at least level 6, who has the relevant certificate at the time of submission and has been added to Elektrilevi’s partner portal before the opening of tenders. The bidder must also have an employee with valid switching rights for switching operations related to the works in the 0.22–20 kV electricity network, and a person appointed as responsible for the work operation, both entered into the EPP environment before the opening of tenders. The bidder must provide the names, job titles and contact details of the contract signatory or signatories and the contact person for contract performance matters; if the right of representation does not arise from the articles of association, a power of attorney must be included. The bid must be submitted using the price table set out in the procurement documents, and all unit price fields must be completed. The bidder must confirm that the bid complies with the procurement documents and that it selects the contracting authority’s standard payment term unless it joins the factoring programme.
