Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds apply: the bidder’s management or representative persons have not been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering, illegal use of labour or human trafficking, and the company has no tax, duty or environmental charge arrears, or social security contribution arrears under the law of its country of establishment. The bidder must also confirm that none of the optional exclusion grounds apply, such as a serious or persistent breach of a previous public contract or the submission of false information about qualification. In addition, the bidder’s place of residence or establishment must not be in the Russian Federation or the Republic of Belarus, and the materials, equipment and goods used in the works must not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin for verification.
Qualification criteria and exclusion grounds
The bidder must have, during the 60 months preceding the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, at least one of which must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance periods, contact details of the other contracting parties and, in the case of public procurements, reference numbers. On the contracting authority’s request, evidence of proper performance of those contracts must be provided. In addition, the team must include a person with valid switching rights entered in Elektrilevi’s partner portal before the deadline for submitting tenders, a person appointed as responsible for the work operation, and a person in charge of electrical works with valid A-competence or at least level 6 qualification under the Vocational Education Institutions Act, who has the relevant certificate at the time of submission and is also entered in the EPP. In the case of a joint tender, an authorised representative must be named and a power of attorney must be attached if the right of representation does not arise from the articles of association. The bidder must also provide the names and contact details of the contract signatory(ies) and the contact person.
