Compliance requirements
A bidder may be excluded if the bidder, or a member of its administrative, management or supervisory body, procurator, or another person authorised to represent, decide for or control the bidder, has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, terrorism-related offences, money laundering or terrorist financing. Exclusion also applies to convictions for enabling the employment of a foreign national staying in the country unlawfully or paying such a person less than the statutory wage, as well as offences involving the unlawful use of child labour or human trafficking. The bidder must not have outstanding national tax, payment or environmental-charge debts, or tax or social security contribution debts under the law of its country of establishment, and the conclusion of the contract must not breach an international or Government of Estonia sanction. The contracting authority’s restriction based on the bidder’s place of residence or establishment also applies. A bidder established outside Estonia must submit a criminal-record extract or equivalent document proving the absence of the relevant grounds, as well as a certificate from the competent authority confirming the absence of tax debts.
Qualification criteria and exclusion grounds
The bidder’s net turnover must have been at least EUR 1,000,000 in each of 2024 and 2025. During the last 5 years, or 60 months, the bidder must have completed at least one similar livestock-farming building project with a minimum size of 500 m²; the project name and location must be provided. The team must include a construction project manager who is a qualified construction engineer at level 6 or equivalent, a construction site manager who is a construction foreman at level 5 or equivalent, and a designer who is a qualified construction engineer at level 7 or equivalent. The required documents must be submitted to prove these qualifications. In the case of a joint tender, a power of attorney for the joint tenderers must be provided. The bidder must confirm that it will not use, during contract performance, a subcontractor who would have to be replaced because of an exclusion ground. The tender must comply with all tender documents, must be unconditional, and, where relevant, explanations and evidence of equivalence must be submitted. Before submitting the tender, the bidder must attend a guided site visit at the time designated by the contracting authority and provide proof of attendance; a tender submitted without the site visit will not be considered. The tender price must be submitted in the prescribed structure using separate price forms for the stable and the manure storage facility.
