The bidder must confirm that neither it nor its management or supervisory board members or representatives have, during the last five years, been convicted by a final judgment of offences such as participation in a criminal organisation, corruption, fraud, terrorism, money laundering, terrorist financing, illegal employment of children or human trafficking. The bidder must also have no tax or social security payment arrears and must not have breached environmental, social or labour law, be bankrupt, under liquidation or insolvency proceedings, have committed a serious breach of professional conduct, entered into anti-competitive agreements or have an unresolved conflict of interest. Exclusion may also result from a serious breach of a previous public contract, submission of false information, failure to provide required information or documents, improper influence over the procurement procedure, breach of sanctions, enabling the employment of an unlawfully residing foreign national, certain tax offences or breach of participation restrictions set out in the tender documents. For taxes and social security contributions, the stated threshold is EUR 0; however, a tax debt certificate is not issued in certain cases, including where the debt is below EUR 100 or payment has been deferred. Where an exclusion ground exists, evidence of remedial measures may be submitted in certain circumstances. The bidder must provide the ESPD declarations and, where required, relevant evidence.

The machine-readable notice does not specify exact turnover, previous experience, staffing or other separate qualification requirements; these must be checked in the tender documents. The bidder must nevertheless meet the compliance requirements for each lot. The tender must be unconditional and comply with all tender documents. A bidder may submit a tender for up to three lots, and contracts may be awarded to one bidder for up to three lots. The tender must include the completed offered-goods price form, together with confirmation that the offered goods meet the descriptions in the form and will be available throughout the framework agreement period. The tender price must be provided in the prescribed structure. Tissue-paper products must comply with the EN ISO 14024 Type I ecolabel or an equivalent standard of a European standards organisation. In a joint tender, a power of attorney for the joint tenderers must be included. The bidder must also provide details of authorised senior persons who can represent, make decisions for or control the bidder but are not visible in the commercial register. Any trade secret must be identified and justified; the tender price and numerical characteristics relevant to the award criteria for supplies may not be classified as trade secrets. The bidder must confirm that it will not use subcontractors or suppliers accounting for more than 10% of the contract value if they are Russian nationals, residents or entities established in Russia, entities more than 50% directly or indirectly owned by them, or representatives or persons acting on their instructions. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned territories.
