Compliance requirements

The bidder must confirm that none of the exclusion grounds under Section 95(1)(1), (4) or (5), Section 95(4)(3) or (4), or Section 177(2) of the Estonian Public Procurement Act apply to the bidder, its management or supervisory board members, or persons authorised to represent, control or make decisions on behalf of the bidder. These grounds include, among other matters, participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, unlawful use of child labour, tax or social security debt, and sanctions-related circumstances. The checks also cover enabling illegally staying foreign nationals to work and the applicability of international sanctions. The bidder must confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers who are Russian citizens, residents or entities established in Russia, or entities controlled by or acting on the instructions of such persons. The bidder must also not use a subcontractor that would have to be replaced under Section 122(7) of the Act. Incorrect confirmations may result in rejection of the tender or exclusion of the bidder.

Qualification criteria and exclusion grounds

The bidder must have properly performed similar design and construction works as the main contractor during the 60 months preceding the commencement of the procurement, on at least three sites. Each site must have involved the design and construction of a cooling system with at least two outdoor units and at least ten indoor units, with a total cooling capacity exceeding 30 kW. This experience must be evidenced by confirmation from the client’s legal representative or contract contact person, using Form I in Annex 1 to the procurement documents. The bidder must provide responsible personnel holding valid professional certificates. The person responsible for managing the works, acting as the lead project manager, must hold at least a level 7 or higher diploma-level civil engineering qualification, specialising in building construction with competence in construction management, or a level 7 or higher diploma-level heating, ventilation and cooling engineering qualification with competence in managing construction activities for cooling systems. The person responsible for managing the cooling-system design works must hold at least a level 7 or higher diploma-level heating, ventilation and cooling engineering qualification with competence in designing indoor-climate systems. The responsible personnel must be specified using Form II in Annex 1. If the bidder relies on the resources of another person or entity, it must submit that person’s or entity’s written and signed consent, describe the technical or professional capacity being relied upon, and confirm that the supporting person or entity will participate directly in contract performance at least to the extent on which the bidder relies for qualification. The tender must comply with all procurement documents, be unconditional, and its price must be submitted in the prescribed structure and using the price schedule in Annex 6. Where relevant, equivalence must be explained and supporting evidence provided. In a joint tender, a power of attorney for the joint tenderers must be included. Any trade secret must be identified and justified, but the tender price and figures relating to the award criteria may not be classified as trade secrets.
