Compliance requirements
A bidder may be excluded if, within the last five years or for as long as an exclusion period remains in force, the bidder or a person authorised to represent, manage, decide for or control it has a final conviction for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, child labour or another form of human trafficking. Exclusion grounds also include unpaid taxes or social security contributions in the relevant country; significant or persistent breach of an earlier public contract resulting in early termination, damages, a price reduction or a contractual penalty; enabling a foreign national to work unlawfully or breaching the applicable employment conditions; entering into the contract in violation of an international or Estonian government sanction; and being subject to a restriction on the right to submit a tender based on the bidder’s place of establishment or residence. The stated threshold for tax and social security payment defaults is EUR 0; the notice also explains that an Estonian tax-debt certificate is not issued where the relevant debt is below EUR 100 or payment has been deferred. Where permitted, a bidder may provide evidence of remedial measures demonstrating restored reliability.
Qualification criteria and exclusion grounds
The bidder’s team must comprise at least 3 people: one coordinator/project manager and at least 2 service specialists. The coordinator may also be one of the specialists. The bidder must provide a team list and description and the coordinator/project manager’s CV.
At least 2 specialists must meet one of these alternatives: they have higher education and occupational therapist training; or they hold at least a bachelor’s degree in psychology, social sciences or education and have previous experience in substitute care. The experience must have been gained during the 72 months preceding the start of the procurement and must involve analysing cases concerning a child in institutional substitute care and/or counselling or guiding staff at substitute-care or family homes. The CV must describe the experience in a way that allows its duration in hours to be assessed.
The bidder must submit CVs for all specialists who will perform the contract, copies of documents proving their education and training, and each team member’s confirmation that they agree to join the team and are ready to perform the contract. The CVs must provide enough detail to assess competence and relevant prior experience and will be used to assess the added value of the team’s experience; the supplied text does not state the detailed scoring for this award criterion. If the service involves contact with a child, including talking to or observing the child, the bidder must comply with section 20 of the Child Protection Act and confirm that the required check will be carried out.
The tender must comply with the procurement documents and must be unconditional. If an equivalent solution is offered, its equivalence must be explained and supporting evidence provided. For a joint tender, a power of attorney for the joint tenderers must be submitted. Any business secrets must be identified and the designation justified; the tender price and numerical figures corresponding to award criteria may not be designated as business secrets. The notice sets no separate bidder turnover or other financial-capacity requirement.
