Compliance requirements

The bidder and each member of a joint tender must confirm that none of the exclusion grounds specified in Section 95(1), points 1–3 and 5 of the Estonian Public Procurement Act apply. The bidder or joint tender member must not be bankrupt, in liquidation, subject to bankruptcy or liquidation proceedings, have suspended business activities, or be in a comparable situation. The bidder and each joint tender member must have no outstanding state taxes, public charges, environmental charges, taxes, or social security contributions. The bidder’s average employee remuneration during the reference period must have exceeded 70% of the average remuneration in the same period in the sector corresponding to the subject matter of the contract. This must be evidenced by an extract from the Estonian Tax and Customs Board. The bidder must not be a related person to the technical consultant advising the beneficiary on the reconstruction of the apartment building. In a joint tender, these requirements apply to every joint tender member, and the exclusion grounds will be checked for the successful bidder or for all joint tender members.

Qualification criteria and exclusion grounds

The bidder must be registered in the Estonian Register of Economic Activities for the construction sector, covering general construction, indoor climate systems, and the construction of internal or building-related water supply and sewerage systems. When carrying out electrical work, the bidder must also be registered for the construction and installation of electrical installations. Foreign bidders may provide equivalent proof of competence. The bidder’s net turnover in the financial year preceding submission of the tender must be at least twice the estimated VAT-exclusive value of the contract to be concluded. By the date of contract signature at the latest, the bidder must be able to provide a first-demand construction-period guarantee issued by a credit institution, financial institution, or insurer, amounting to 5% of the VAT-exclusive construction contract value. If the guarantee is provided after signature, it must be submitted within 10 calendar days of signing and remain valid throughout the construction period. Depositing the corresponding amount with the beneficiary or a notary is also acceptable. During the 60 months preceding the start of the procurement procedure, the bidder must have completed at least one equivalent construction project as the main contractor, with a value of at least half of the estimated contract value. The project must have involved the construction, extension, or full reconstruction of a building, including the construction or reconstruction of load-bearing structures and external envelopes, heat-recovery mechanical ventilation, and a new heating system. The bidder must provide the project name and building details, execution period, value, scope, and evidence of completion. Evidence must be an Estonian Register of Buildings notice of use or occupancy permit reference, or a copy of an acceptance certificate signed by the client and contractor. The team must include a project manager with at least a level 6 building engineer or construction manager qualification, a site manager with at least a level 5 construction foreman qualification, a ventilation and heating systems specialist with at least the relevant level 6 engineering or construction manager qualification, a water supply and sewerage systems specialist with at least the relevant level 6 engineering or construction manager qualification, an electrical worker with at least a B-class competence certificate or level 6 electrical engineer qualification, and an authorised architect at level 7. The bidder must provide each person’s name and professional or competence certificate number; equivalent qualifications are permitted for foreign personnel. For construction activities, the bidder must have a quality management system meeting at least EVS-EN ISO 9001 and an environmental management system meeting at least EVS-EN ISO 14001, or equivalent systems. The relevant certificates or other evidence must be submitted.
