The bidder and each joint tenderer must confirm that none of the exclusion grounds referred to in points 1–3 and 5 of subsection 1 of Section 95 of the Public Procurement Act applies to them. The bidder must also not be bankrupt, in liquidation, subject to bankruptcy or similar proceedings, or have its business activities suspended, and must not have outstanding national taxes, public charges, environmental charges, tax payments or social security contributions. The bidder must confirm that its employees’ average remuneration during the reference period was more than 70% of the average remuneration in the field corresponding to the subject matter of the contract during the same period. This must be evidenced by an extract from the Estonian Tax and Customs Board. The bidder must also confirm that it is not a related person to the technical consultant advising the beneficiary on the reconstruction of the apartment building. In a joint tender, the exclusion grounds are checked separately for each joint tenderer.

The bidder must be registered in Estonia’s economic activities register for construction activities covering general building construction, indoor climate systems, and internal or associated water supply and sewerage systems. Where electrical works are performed, registration must also cover the construction and installation of electrical installations. A foreign bidder may submit evidence of equivalent competence. The bidder’s net turnover in the financial year preceding submission of the tender must be at least twice the estimated VAT-exclusive value of the contract. The input does not state the exact contract value or the resulting turnover amount, so the required figure must be determined from the tender documents. During the 60 months preceding the start of the procurement procedure, the bidder must have completed at least one equivalent construction project as the main contractor, with a value of at least half of the estimated VAT-exclusive contract value. The project must have involved construction, extension or full reconstruction of a building and must have included at least the construction or reconstruction of the building’s load-bearing structures and external envelope, heat-recovery mechanical ventilation, and a heating system. Experience must be evidenced by a reference to a building register occupancy notice or use permit, or by a handover and acceptance certificate signed by the client and contractor. The team must include a project manager with at least a level 6 building engineer or construction manager qualification, a site manager with at least a level 5 qualification for general building works, a ventilation and heating systems specialist with the required level 6 competence, a water supply and sewerage systems specialist with the required level 6 competence, and an electrical works professional holding at least a B-class competence certificate or a level 6 electrical engineer qualification in consumer electrical installations. The team must also include an authorised level 7 architect responsible for ensuring that the building design complies with the requirements of the New European Bauhaus. The name and professional or competence certificate number must be provided for each person; a foreign bidder may provide a person with equivalent competence. The bidder must have a quality management system applied in the field of construction that meets at least the requirements of EVS-EN ISO 9001 and an environmental management system that meets at least the requirements of EVS-EN ISO 14001. Copies of the relevant standards or evidence of equivalent systems must be submitted. The bidder must be able to provide, no later than the date of contract signature, an on-demand guarantee issued by a credit institution, financial institution or insurance company, amounting to 5% of the VAT-exclusive construction contract value. If the guarantee is provided after contract signature, it must be submitted within 10 calendar days and remain valid throughout the construction period. Depositing the relevant amount into the beneficiary’s or a notary’s account is also permitted. The tender must be submitted using the contracting authority’s form; conditional tenders are not permitted. The total tender price and its allocation by cost line must be clearly stated. If team members who are not employees of the bidder are used, their written consent must be included. In a joint tender, a power of attorney must specify the size and nature of the contract part performed by each joint tenderer. A power of attorney proving representation must be submitted when the tender is signed by an authorised representative.
