Compliance requirements

The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurators or other persons authorised to represent, decide for or control the company have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, illegal use of child labour or other human-trafficking offences, or remain subject to an exclusion obligation arising from such a conviction. The bidder must not have breached its obligations to pay taxes or social security contributions. For tax debt, the tender document notes a EUR 100 threshold and an exception for deferred tax debt. The bidder must not have breached obligations concerning the employment of unlawfully staying foreign nationals or the conditions for employing foreign nationals in Estonia, and must not be in a situation where contract award would violate an international or Estonian sanction. The bidder must also not be prohibited from submitting a bid due to a restriction set out in the tender documents. The bidder must provide the declarations required in the European Single Procurement Document and, where applicable, supporting evidence. If an exclusion ground applies, the bidder may submit information on measures taken to restore its reliability where such self-cleaning is permitted for this procurement.

Qualification criteria and exclusion grounds

The bidder must submit the tender form, or the required information in an equivalent format, together with an initial description of the e-course and the bidder’s measures for mitigating risks related to its development. The bid must comply with the technical specification and other tender documents; conditional bids are not permitted. The project team must include at least a learning designer/production coordinator, a subject-matter expert and a video file specialist. One person may perform several roles if they meet the requirements for each relevant role. The bid must include the completed project team requirements, experience and declaration form, describing the team composition, allocation of roles, competences and experience. Copies of documents proving the higher education of the learning designer/production coordinator and the subject-matter expert must be submitted. The contracting authority may request additional information and evidence, which must be provided within 3 working days; incomplete information may result in rejection of the bid. The detailed experience and competence requirements for the roles must be checked in the relevant tender document. The total tender price must be submitted in euros excluding VAT, with two decimal places, using the prescribed form and structure. The required data in the form may not be changed and negative prices are not permitted. The bidder must favour environmentally friendly solutions, including online meetings, digital materials, optimally sized files and deletion of unnecessary digital materials after contract performance. The service must comply with equal treatment, non-discrimination and accessibility principles, including accessibility for people with physical disabilities. For a joint bid, each joint bidder’s European Single Procurement Document and a power of attorney must be submitted. The bidder must also identify persons authorised to control the company who are not visible in the commercial register, or confirm that no such persons exist.
