Compliance requirements

The bidder will be excluded if any exclusion grounds under Section 95(1) of the Public Procurement Act apply. The same check is also carried out for any entity whose resources the bidder relies on to prove qualification. The bidder must confirm that neither it nor, where relevant, the supporting entity has any exclusion grounds. In addition, entities whose place of residence or establishment is in the Russian Federation or the Republic of Belarus are not allowed to participate. If the bidder relies on another person’s qualification, the same prohibition applies to that person as well.

Qualification criteria and exclusion grounds

The bidder must have a net turnover of at least EUR 100,000 in each of the last three completed financial years before the start of the procurement. The bidder must also have completed, within the 36 months before the contract notice was published, 2 contracts for design work similar to the subject of the procurement. Similar design work means a contract where the bidder acted as the main contractor, the design covered a building, part of a building or a building complex with at least 500 m² of enclosed net floor area, and the work reached at least the preliminary design stage, including architectural, structural, building services and electrical design. The bidder must submit Form 1 with the contract details. For the project team, the bidder must include a project manager with at least the qualification of a certified civil engineer, level 7, specialization in building construction, with competence in design management or preparation of a building design project, or an equivalent qualification. For direct design work, the bidder must include specialists for high-voltage systems and for heating, ventilation and cooling. For high-voltage systems, acceptable qualifications are a class B competence certificate with the right to carry out design work, or a certified electrical engineer, level 7, with the relevant specialization and design competence. For heating, ventilation and cooling, the specialist must have at least the qualification of certified heating, ventilation and cooling engineer, level 7, with competence in indoor climate system design, or an equivalent qualification. The bidder must submit Form 4 with the required specialist details. If a specialist’s qualification certificate was issued outside Estonia, the bidder must provide both a copy of the certificate and a document from the competent Estonian authority confirming equivalence. If the high-voltage specialist is proven by a competence certificate, a copy of that certificate must be attached. The bid must also comply with the tender documents, and the bidder must confirm equivalence where required. If the bid is submitted jointly, Form 8 on joint bidding and joint liability must be provided.
