Compliance requirements

The bidder must confirm that neither the company nor its representatives or controlling persons have relevant final convictions within the last five years, including participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour and other forms of human trafficking. The bidder must not have unpaid taxes or social security contributions. The notice states that a tax debt below EUR 100, excluding certain undetermined interest, or an agreed payment schedule is treated in accordance with the Taxation Act. The bidder must also comply with the national exclusion grounds concerning illegal employment of foreign nationals, international sanctions and any restriction on participation based on the company’s place of establishment or residence. If an exclusion ground applies, the bidder may provide evidence of remedial measures where permitted by law or the tender documents. The bidder must confirm that the offered service or relevant goods are not subject to international sanctions or originating from sanctioned regions.

Qualification criteria and exclusion grounds

The machine-readable notice does not specify precise financial capacity, experience, registration or staffing requirements; these must be checked in the tender documents. The bidder must submit the completed price form with all service unit prices in euros excluding VAT. The quoted unit prices may not exceed the corresponding prices in the bidder’s business customer price list valid on the submission deadline; the bidder must provide that price list for verification if requested. During contract performance, at least 23.1% of the M1, M2 and N1 vehicles used must have CO2 emissions below 1 g/km, and at least 9% of the N2 and N3 vehicles must either have CO2 emissions below 1 g/km or use alternative fuels. For a joint tender, the bidders must appoint an authorised representative, submit the relevant power of attorney and provide a separate ESPD for each joint bidder. The bidder must also identify authorised persons who are not visible in the commercial register, or confirm that there are no such persons.
