The bidder must confirm that none of the mandatory exclusion grounds apply. These include relevant criminal convictions involving the bidder or its management, representatives or controllers, convictions related to illegal employment of foreign nationals or underpayment, illegal child labour or human trafficking, outstanding tax or social security debts, and circumstances that would breach international or government sanctions. The contracting authority may also exclude a bidder that is bankrupt, being liquidated, subject to insolvency proceedings, has suspended business activities, has seriously or repeatedly breached a previous public contract, or has provided false information or failed to submit requested supporting documents. Each member of a joint bid must provide the exclusion-ground confirmations separately. The same applies to an entity whose technical or professional capacity the bidder relies on. The bidder must also confirm that it will not use a subcontractor who would have to be replaced under the applicable public procurement rules, and that it and persons acting on its behalf have not committed corrupt acts in this procurement.

The bidder’s total net turnover must have been at least EUR 160,000 in each of the last three financial years completed before the start of the procurement. The bidder must provide the turnover figures in the European Single Procurement Document; upon request, it must submit an extract from the annual report or another suitable proof if the information is not publicly available. If the bidder relies on another entity’s financial resources, that entity must also provide the required procurement passport information. The contract team must include a project manager who will participate directly in contract performance. The project manager must have managed at least two conservation or restoration projects involving cultural monuments, including general construction works, as the contractor’s project manager during the five years preceding the start of the procurement. A CV in the required Annex 4 format must be submitted. If the project manager is not employed by the bidder, the CV must be digitally or handwritten signed to confirm consent to participate. The project manager must hold either a qualification equivalent to Construction Engineer, level 6, specialising in building construction and construction activity management, or Construction Manager, level 6, specialising in general construction with the required competencies in stone and concrete, timber and steel structures, demolition and façade works. The qualification certificate or the information needed to verify it, including the project manager’s personal identification code, must be provided. By the contract award date, the bidder must hold the required Estonian Register of Economic Activities notices for general construction and for conservation and restoration of monuments or buildings located on a world heritage site, or an equivalent registration or permit under the law of its country of establishment. A foreign bidder must provide a certificate from the competent authority before contract conclusion. The tender must be unconditional, comply with the procurement documents and include any required evidence of equivalence. Joint bidders must submit a power of attorney for their authorised representative. The price offer must follow the prescribed structure, include all unit prices and total costs in euros both excluding and including VAT, and be submitted to two decimal places using the Annex 2 price table. Every row must be completed without alterations or additional conditions. Negative prices are not permitted, and the prices must include all costs necessary for proper performance of the works.
