Compliance requirements
The tender documents include the standard exclusion grounds under the Estonian Public Procurement Act, including criminal organisation participation, corruption, fraud and other mandatory exclusion grounds. If an exclusion ground applies, the bidder may be allowed to prove self-cleaning measures where the procurement documents provide for this or where the law allows it. The machine-readable notice does not list all exclusion grounds in full; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must show an annual turnover of at least EUR 100,000 in each of the last three completed financial years before the start of the procurement. The bidder must provide turnover data in the ESPD and, if requested, the last three annual reports or extracts if the data are not publicly available.
Within the 36 months before the start of the procurement, the bidder must have completed at least one electrical installation operation management service contract worth at least EUR 10,000 excluding VAT. A list of such contracts must be provided with contract value, dates and client contact details; if the service was provided under a framework agreement, qualification may be demonstrated through contracts concluded and performed under that framework agreement.
The bidder must involve at least one operation management specialist with at least B competence class or at least level 5 electrical qualification. The bid must include the specialist’s professional qualification certificate and, if the specialist is not employed directly by the bidder, a confirmation that the specialist will actually participate in contract performance.
The bidder or its subcontractor must have filed a business activity notice for the activity area “electrical works” or hold an equivalent registration or licence under the law of its country of establishment. If the bidder relies on a subcontractor, it must show that the person holding the registration will personally perform the relevant part of the contract.
The bid must comply with the tender documents, include the required price form and, in the case of a joint bid, the joint bidders’ power of attorney. Conditional bids are not allowed. Any required confirmations, evidence or forms must be submitted in the format required by the tender documents.
