Compliance requirements

The bidder must confirm that neither it nor the members of its management, administrative or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption or fraud. The same check applies to the other exclusion grounds listed in the ESPD, including terrorism-related offences, money laundering, child labour and human trafficking. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where allowed. The bidder must also confirm that it does not use a subcontractor subject to replacement under the Public Procurement Act and that it does not involve, for more than 10% of the contract value, citizens, residents or companies established in the Russian Federation, or persons linked to them. In addition, the bidder must confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas.

Qualification criteria and exclusion grounds

The bidder must have average annual net turnover of at least EUR 100,000 excluding VAT for the last 3 financial years ended by the start of this procurement (01/01/2023–31/12/2025). During the whole contract period, the bidder must involve a responsible person (works manager) who has at least the professional qualification "Construction manager, level 6" or equivalent/higher, and/or "Construction engineer, level 6" or equivalent/higher. If an equivalent qualification is used, the bidder must provide proof of the person’s competence. If the person does not hold the required Estonian professional or competence certificate, the bidder must submit a copy of the activity licence/professional certificate issued in the person’s country of establishment or proof that the person is entitled to perform the relevant work under the laws of that country. The bidder must provide the responsible person’s name and professional certificate number. The bidder must also confirm that the bid complies with the tender documents and that any equivalence has been explained and supported by evidence. The bid must include the required price form. The bidder must confirm that it attended the mandatory guided site visit at the time set by the contracting authority. If the bid is a joint bid, a joint bidders’ power of attorney must be attached. The bidder must also provide the required confirmations regarding trade secrets, non-involvement of a subcontractor subject to replacement under the Public Procurement Act, EU sanctions on subcontractors and suppliers, and that the offered goods are not subject to international sanctions or originate from sanctioned areas.
