The bidder must confirm that neither the bidder nor persons with management, supervisory or representative powers have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, illegal use of child labour or human trafficking-related offences. The bidder must also have no tax or social security debt, bankruptcy, liquidation or similar insolvency proceedings, or suspended business activities. Compliance with environmental, social and labour law obligations is examined, as are serious professional misconduct, anti-competitive agreements, conflicts of interest, material breaches of previous contracts, and the submission of false information or failure to provide required documents. Additional national exclusion grounds concern enabling the employment of an unlawfully staying foreign national, international sanctions, tax offences and restrictions on the right to participate in the procurement. Where legally or procedurally permitted, a bidder affected by an exclusion ground may provide evidence of remedial measures demonstrating restored reliability.

The machine-readable notice and the provided ESPD text did not contain precise financial or technical qualification requirements, such as turnover, reference or certification requirements; these must be checked in the tender documents. A tender may be submitted for up to two lots. The bidder must submit the completed Annex 2 technical compliance and pricing form, confirm that the proposed goods comply with the descriptions in the form, and ensure that the goods remain available throughout the framework agreement period. The tender must comply with all tender-document requirements, and conditional tenders are not permitted. Where relevant, equivalence must be explained and supporting evidence provided. If the bidder’s authorised representatives are not visible in the commercial register, their names and personal identification codes must be submitted. In a joint tender, a power of attorney from the joint bidders must be included. The supplied goods must not be subject to international sanctions or originate from sanctioned regions. The bidder must prefer low-packaging or reusable packaging and, at the customer’s request, take back packaging free of charge for reuse or recycling. During contract performance, only subcontractors and suppliers established in Estonia, an EU Member State, an EEA contracting state or a country party to the WTO Government Procurement Agreement may be used.
