Compliance requirements

The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, nor other persons authorised to represent it, have been convicted of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, illegal employment of a foreign national staying in the country without legal basis, child labour or human trafficking, or any other exclusion ground listed in the tender documents. The bidder must also confirm that it has no tax, fee or environmental charge arrears, and no tax or social security contribution arrears under the law of its country of establishment, and that neither the bidder nor a member of its governing body is subject to international sanctions. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures where this is permitted.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register or provide proof of the equivalent registration in its country of establishment. The bidder’s total annual turnover must be at least EUR 200,000. The bidder must hold an operating licence in the field of fuel sales, or an equivalent registration or licence under the law of its country of establishment; if relying on a subcontractor, a separate ESPD for that other entity must be submitted. The bidder must have properly performed at least three similar contracts during the last 36 months, involving direct production and sale of heat energy to at least three institutions, with at least 900 MWh per year for each institution; the contracting authority also treats the sale of fuel needed for heat production together with heat production and maintenance of heat production systems as similar activity. A list of completed works on Form 2 must be submitted with the tender. In addition, the bidder must involve a direct user and a supervisor of pressure equipment and submit a copy of the certificate proving the supervisor’s competence; for the bidder’s own employee, registration of employment must be proven, and for another person, a contractual agreement for using the specialist must be provided. The tender may also be submitted as a joint tender, in which case a power of attorney from the joint bidders must be attached. The bidder’s right of representation must be proven; for an Estonian bidder the contracting authority checks this in the commercial register, while a foreign bidder must submit the relevant document issued in its country of establishment.
