Compliance requirements

The tender documents include the standard exclusion grounds. The bidder must confirm that none of the mandatory exclusion grounds apply, including participation in a criminal organisation, corruption, fraud and the other grounds listed in the ESPD. If an exclusion ground exists, the bidder may provide evidence of self-cleaning where allowed. The machine-readable notice does not provide the full detailed wording for all exclusion grounds; the official tender documents must be checked.

Qualification criteria and exclusion grounds

The bidder's net turnover for each of the last 3 financial years must be at least EUR 220,000. The bidder must submit at least 1 contract performed within the 36 months before the start of the procurement, covering development and/or operational management of an intellectual property management software solution, including patent portfolio management, licence agreement management, and support for disclosure and confidentiality processes, with a managed portfolio of at least 50 active patents and/or patent applications. A technical bid, a video demonstration or link to it, and, if needed, screenshots must be submitted so the buyer can verify compliance with the technical specification. If the bid is signed by a representative whose authority is not shown in the register, a power of attorney must be provided. In a joint bid, a power of attorney for the joint bidders and ESPD documents for all joint bidders must be submitted. If the bid contains trade secrets, this must be identified and justified separately.
