Compliance requirements
The bidder and its management body members must not have been finally convicted within the last five years for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour or other forms of human trafficking, participation in a criminal organisation, or committing a terrorist act or offences related to terrorist activity. The bidder must also confirm that it will not use a subcontractor in contract performance who would have to be replaced under Section 122(7) of the Public Procurement Act, and that the bidder is not established in the Russian Federation or the Republic of Belarus. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where this is allowed.
Qualification criteria and exclusion grounds
The bidder must have completed at least 1 construction or reconstruction contract for a quay structure or port facility within the 60 months before the publication of the contract notice in the public procurement register. To verify references, the bidder must provide the contract name, client name, short description of the work, time of performance and the procurement reference number if the contract was awarded through public procurement. The contracting authority may request the client’s written confirmation that the reference contract was performed properly. The bidder must also involve at least one specialist with either a level 7 certified hydraulic engineer qualification, a level 8 authorised hydraulic engineer qualification, or an equivalent professional qualification; or a level 7 certified civil engineer qualification with specialisation in port construction, a level 8 authorised civil engineer qualification with specialisation in port construction, or an equivalent professional qualification. The bidder must provide the specialist’s name and qualification details. If the qualification can be checked in a public register, separate proof documents are not required; otherwise the contracting authority may request additional evidence.
