Compliance requirements

The bidder must confirm that neither the bidder nor its management or supervisory board members, procurist, or other authorised representatives are subject to the exclusion grounds under Section 95(1) of the Estonian Public Procurement Act. These include, among other things, convictions for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, enabling unlawful employment, unlawful use of child labour, or human trafficking, as well as outstanding tax, payment or environmental charge debts and being subject to international sanctions. The contracting authority may also exclude a bidder for a serious or repeated breach of a previous public contract, false information concerning the selection requirements, or failure to submit required information or documents. Companies established or resident in the Russian Federation or the Republic of Belarus may not participate. The bidder must also confirm that materials, equipment and components used in the works are not produced in or sourced from Russia or Belarus; certificates of origin may be requested.

Qualification criteria and exclusion grounds

The bidder’s net turnover must have been at least EUR 1,100,000 in each of the last three completed financial years. Extracts from the relevant annual accounts must be submitted, unless the information for an Estonian-registered legal entity is publicly available to the contracting authority from a state database. At least six months must have elapsed since the end of the latest completed financial year by the bid submission date. During the 60 months preceding the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject matter of this contract. At least one contract must have had a value of at least EUR 300,000 excluding VAT. The bidder must submit a list of the contracts showing the performance period, the contact details of the client’s representative, and the reference number for public contracts. Evidence of proper completion must be provided on request, unless the contracting authority can obtain it from public or private databases without significant expense. The list must be submitted using Form 2. The bid must include the price offer table in Form 1, with all unit-price fields completed, and the reserve switchgear price table in Form 1.1. The technical information forms for the medium-voltage equipment at Kõpu and Tõstamaa, Forms 5.1 and 5.2, must also be completed; partially completed forms may lead to rejection. From 1 January 2026, medium-voltage equipment up to and including 24 kV may not use fluorinated greenhouse gases (SF6) as the insulating or interrupting medium. If the bidder offers both SF6 and SF6-free equipment, separate bids must be submitted. The bidder must have a person responsible for managing electrical works with valid A competence or a qualification corresponding to at least level 6 under the Estonian Professional Qualifications Act, registered in the Elektrilevi Partner Portal before bids are opened. The bidder must also have a person responsible for the work operation with valid rights, likewise registered in the portal before bids are opened. The names, job titles, email addresses and telephone numbers of the contract signatory and the contract performance contact person must be provided; a power of attorney must be included where signing authority does not arise from the articles of association. If subcontractors are used, the subcontractor list must be submitted using Form 3. The bidder must be prepared to use the Elektrilevi Partner Portal during contract performance.
