Compliance requirements
The bidder must confirm that the company, its administrative, management or supervisory board members, and persons authorised to represent or control it have not received final convictions still in force from the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the use of child labour or other forms of human trafficking. The bidder must also have no outstanding tax or social security payment obligations. For taxes and social security contributions, the notice specifies a threshold of EUR 0, while noting that a tax debt certificate is not issued, among other cases, for debt below EUR 100 or deferred tax debt. The bidder must confirm that entering into the contract would not breach an international or Estonian sanction and that it is not subject to the exclusion ground concerning enabling an unlawfully staying foreign national to work. Where permitted, a bidder affected by an exclusion ground may submit a description and evidence of measures taken to restore its reliability.
Qualification criteria and exclusion grounds
During the 60 months preceding the start date of the procurement, the bidder must have completed at least three ventilation construction contracts as a contractor in public-use buildings. All contracts must be fully completed by the tender submission deadline, properly completed in accordance with good construction practice and handed over. Under at least one contract, an old ventilation unit must have been replaced or a new unit installed, with a capacity of at least 10,000 m³/h. The experience and supporting information must be provided using Form IV of Annex 1.
The bidder's team must include a construction manager who has experience managing renovation works in healthcare facilities during the previous 36 months and holds a Level 7 diploma engineer qualification in heating, ventilation and cooling. An entry-level qualification is not accepted.
The bid must include the Form 1 application to participate, the Form 2 quantity and price breakdown, and the Form 3 confirmation of willingness to conclude the contract. Conditional bids are not permitted. The bid price must be submitted in the required structure, and technical information on the proposed ventilation unit must be provided so that compliance with the technical specification can be assessed. If equivalence is relied upon, it must be explained and supported with evidence. For a joint bid, a power of attorney from the joint bidders must be included.
