Design and Construction of New Heating Substations for the F and J Buildings at Ravi 18 and the Järve Unit

The bidder must confirm that neither the bidder, its management or supervisory board members, nor persons authorised to represent it have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, illegal child labour or trafficking-related offences. Grounds for exclusion may also include tax or social security debt, bankruptcy or other insolvency proceedings, liquidation, assets being administered by a liquidator or court, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, involvement in preparing the procurement procedure, a material breach of a previous public contract, false information, or failure to provide required information or documents. The bidder must also address breaches related to employing unlawfully staying foreign nationals, international sanctions, and convictions for tax offences. Where applicable, the bidder must provide explanations and evidence of remedial measures taken to restore its reliability. First-tier subcontractors must submit a European Single Procurement Document where the bidder relies on their resources, and the relevant exclusion grounds also apply to those subcontractors.

For either lot, the bidder must engage a person responsible for the construction works who holds at least a Level 7 chartered HVAC engineer qualification with competence to manage construction activities for heating systems, or a Level 7 thermal energy engineer qualification specialising in heat-generating equipment, heat sources and heating centres. The same person must have at least five years of construction work experience and experience in constructing at least five heating substations during the five years preceding publication of the contract notice. This must be evidenced by the responsible specialist’s CV using Annex 9. Qualifications issued in Estonia will be checked in the public professional qualifications register; for qualifications issued abroad, the bidder must submit a copy of the qualification certificate or other evidence and a document from a competent Estonian authority confirming equivalence with the required qualification. The bid must be submitted using the price form in Annex 4, with the price presented according to the structure of the required worksheet. The bidder must provide the details of the person authorised to sign the contract and, where applicable, a power of attorney, as well as the contract contact person’s details. Conditional bids are not permitted. For a joint bid, Annex 8 authorisation must be submitted; where the bidder relies on another entity’s resources, the consent required under Annex 7 must be included; where subcontracting is used, Annex 6 must identify the subcontractor, the nature of the work and its percentage share. The bidder must confirm compliance with the tender documents, provide explanations and evidence where equivalence is used, refrain from engaging a subcontractor who would have to be replaced under the applicable rules, and comply with restrictions concerning sanctioned subcontractors and suppliers. Subcontractors or suppliers linked to Russian nationals, residents or entities may not account for more than 10% of the contract value; the restriction also covers entities more than 50% owned by such persons or entities and representatives or entities acting under their instructions.
