Ordering transport and destruction services for data carriers, electronic equipment and office equipment for the Tax and Customs Board

The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, procurists or other authorised representatives have been finally convicted within the last five years of participating in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing, or offences involving child labour or human trafficking. The check also covers breaches of tax and social security payment obligations. The exclusion grounds also include breaches of environmental, social and labour law obligations; bankruptcy, liquidation or another insolvency situation; an agreement with creditors; suspended business activities; serious professional misconduct; anti-competitive agreements; conflicts of interest; improper involvement in preparing the procurement; material breaches of previous public contracts; and the submission of false information or failure to submit required documents. They also cover enabling an unlawfully residing foreign national to work, breaches of international or national sanctions, and legal restrictions on participation in public procurement. The bidder must provide the required confirmations and, where applicable, explanations and evidence. Where an exclusion ground applies, evidence of remedial measures restoring reliability may be submitted where permitted by the tender documents and applicable law.

The bidder must hold a valid environmental permit, waste-sector registration or another legally recognised right to transport, handle and destroy the waste covered by the contract. The registration number and, where applicable, permit or registration details must be provided; the contracting authority will verify them in the Environmental Board’s environmental permits register. The bid price must be submitted in accordance with the structure specified for the priced items and evaluation indicators. Conditional bids are not permitted, and submitting a bid confirms acceptance of all conditions set out in the tender documents. For a joint bid, a power of attorney for the joint bidders must be attached. The bidder must identify authorised persons who are not visible in the commercial register, including their personal identification codes, or confirm that no such persons exist. The bidder must identify and justify any trade secrets; the bid price and numerical indicators corresponding to the award criteria may not be classified as trade secrets. During contract performance, environmental requirements must be followed: materials must generally be provided digitally, digital files must be stored and transmitted at an optimal size, and unnecessary draft files must be deleted as soon as possible. Where printing is necessary, products bearing a Type I ecolabel should be preferred. The bidder must confirm that it will not use subcontractors or suppliers exceeding 10% of the contract value who are Russian citizens, residents, entities established in Russia, entities owned or controlled as specified in the tender documents, or their representatives. Subcontractors and suppliers used for contract performance must be domiciled or established in Estonia, an EU Member State, an EEA contracting state or a country party to the WTO Government Procurement Agreement. All personnel involved in providing the service must be bound by confidentiality and personal-data protection obligations and must be informed of the applicable legal requirements.
