Compliance requirements
The bidder must confirm that neither the company, its management or supervisory body members, nor persons authorised to represent, decide for or control it have final convictions within the last five years for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or illegal use of child labour or other forms of human trafficking. The bidder must also have no tax or social security contribution debt; the threshold for checking such debt is EUR 0, subject to the stated exception for tax debt below EUR 100 or rescheduled debt.
The exclusion grounds also cover breaches of environmental, social and labour law obligations; bankruptcy, liquidation or other insolvency situations; assets administered by a liquidator or court; suspended business activities; serious professional misconduct; agreements restricting competition; unresolved conflicts of interest; involvement in preparing the procurement; early termination or sanctions resulting from a material breach of a previous contract; and false information or failure to submit required information or documents. Contract award must not breach international sanctions. Participation is prohibited for an undertaking whose place of residence or establishment is in Russia or Belarus, and for any entity whose capacity the bidder relies on if that entity is established there. The bidder must provide the required declarations in the ESPD and, where applicable, evidence of remedial measures restoring its reliability.
Qualification criteria and exclusion grounds
The bidder must be registered in the required business register of its country of establishment and provide the registration details or supporting evidence.
The bidder’s net turnover in each of the last two financial years completed before the procurement was launched must be at least EUR 500,000. If the financial year corresponds to the calendar year, turnover data for 2024 and 2025 must be provided.
The bidder must have experience in constructing or renovating at least two buildings, each with a closed net floor area of at least 500 m². The bidder must provide descriptions of the works and the required client details; for a private-sector client, a client confirmation of proper contract performance must also be submitted. For a public procurement contract, the procurement reference number must be included in the description.
The bidder must engage a construction project manager with at least a level 6 construction manager professional certificate, specialising in building construction and construction activity management, or an equivalent qualification. The project manager’s details and CV must be submitted using Form 4. For a qualification issued in Estonia, the contracting authority will verify it in the public professional register. For a qualification issued abroad, the bidder must provide the document issued by the competent authority proving the qualification and a document issued by a competent Estonian authority confirming its equivalence to the required qualification.
The tender must comply with the procurement documents. Where an equivalent solution is used, its equivalence must be explained and supporting evidence provided. If the tender is submitted by a person who is not a member of the management body with representation rights, a written power of attorney must be included. Form 2 must be submitted with subcontractor information and a list of documents claimed to contain trade secrets. For a joint tender, Form 8, the representative’s power of attorney and confirmation of joint and several liability must be submitted.
The tender price must be stated in euros excluding VAT both in the relevant procurement register worksheet and in Form 3, with all price table fields completed. During contract performance, all first-tier subcontractors will be checked regardless of contract value, and the subcontractors must be submitted for checking in the register.
