The bidder and its management or control body members must not have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or terrorist offences related to a terrorist act or terrorist activity. The same applies to any other exclusion grounds named in the tender documents. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures where this is permitted. The bidder must also provide details of authorised persons who are not visible in the business register so that the contracting authority can check exclusion grounds. The bidder must confirm that the supplied goods are not subject to international sanctions and do not originate from sanctioned areas.

The bidder must submit a copy of a valid ISO 9001 quality management system certificate or equivalent evidence if the certificate cannot be provided for reasons beyond the bidder’s control. The bidder must also provide the required technical description, technical documents, pictures and, where needed, links to the manufacturer’s website for the device and accessories. According to the compliance conditions, the bidder must have at least 1 service engineer throughout the contract period. The service engineer must have received manufacturer training for maintenance and repair of the specific device, be able to arrive at the service location within 48 hours at the latest, and have at least 3 years of experience in maintenance and repair of extraction equipment. The bidder must submit a copy of the manufacturer’s certificate confirming the engineer’s training and a confirmation that the service team will be available. The bidder must also submit a copy of the document proving maintenance rights for the device, a confirmation of authorised manufacturer technical support in Estonia with a 24-hour response time, and the technical support contact details. The device and accessories must have a warranty of at least 24 months, and the manufacturer must have an ISO 9001 or equivalent quality management system, for which a certificate copy must be submitted. In the case of a joint bid, a power of attorney from the joint bidders must be attached. The bidder must also provide a list of cooperation partners and subcontractors involved in the sale of the device.
