Compliance requirements

The bidder must prove that it has no tax debt. If a tax debt exists, it must not exceed EUR 100 and must not be deferred for more than six months from the start of the procurement procedure, unless the deferral is fully secured. The contracting authority will also exclude a bidder that has tax debt or social security contribution debt at the start of the procedure. In the performance stage, subcontractors’ tax and social security contribution compliance is also checked. The machine-readable notice also contains general exclusion grounds relating to insolvency, liquidation and breaches concerning taxes and social security contributions; the exact conditions must be checked in the tender documents.

Qualification criteria and exclusion grounds

The bidder must have a statutory economic activity registration for constructing the building specified in the tender documents. The bidder’s net turnover in construction activities must have been at least EUR 700,000 in each of the last three financial years. If the bidder has operated for less than three years, the requirement is assessed on the basis of the available financial years during the operating period. Annual reports or profit and loss statements that are not yet due for submission to the commercial register or are not available in the Estonian Business Register must be attached to the bid documents. The bidder must have, as main contractor, completed at least two similar construction works during the 60 months preceding the start of the procurement. A similar project is primarily a workshop, repair, garage, warehouse, production, technical or other building with comparable intended use and technical complexity. For each reference project, the bidder must provide the building data, a short description of the works, the time of performance and the client’s details. The construction project manager and/or site manager must hold at least a valid level 6 certified construction engineer qualification or an equivalent professional qualification. The project manager and/or site manager must have experience in carrying out construction works on at least two similar buildings during the 60 months preceding the start of the procurement. The bidder must confirm the professional competence of the construction project manager and/or site manager and provide the building data, short description of the works, time of performance and client details for the reference projects. The bidder must submit proof that there is no tax debt. The notice states that the bidder must provide a free-form document as evidence. The bidder must submit an MTR extract as a free-form document. The machine-readable notice also requires the bid to be submitted in the structure set out in the worksheet "Award criteria and assessed indicators", confirms that the bid must comply with the tender documents, and requires the bidder to confirm that any equivalence has been explained and supporting evidence attached where relevant. The bid must be unconditional. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas. The works warranty period must be at least 24 months from handover of the works to the contracting authority.
