Compliance requirements
The bidder must confirm that neither it nor persons with management or representation powers have been finally convicted within the last five years for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour or other forms of trafficking in human beings, fraud, terrorism, or any other exclusion ground listed in the tender documents. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. For subcontractors, first-tier subcontractors are checked during contract performance, and if an exclusion ground is found, the subcontractor must be replaced at the contracting authority’s request.
Qualification criteria and exclusion grounds
The bidder must have an average annual net turnover in road works of at least EUR 1,000,000 per year over the last three financial years. Road works means construction, reconstruction, repair and surfacing works for public roads, streets, squares, sidewalks and light traffic roads. The bidder must confirm this in the ESPD and, if requested by the contracting authority, submit the last three annual accounts or another proof of turnover. For a bidder registered in Estonia as a legal person, this proof is not required if the data are publicly available in a register accessible to the contracting authority.
The person responsible for managing the construction works (project manager) must have at least the qualification of road engineer, field: management of construction activities, or an equivalent EQF level 7 professional qualification, except for an initial qualification. The bidder must provide the person’s details in the ESPD and, on request, submit documents proving the qualification, whether the person works directly for the bidder or as a subcontractor.
The bidder must also submit the required subcontractor information if subcontracting is used, including the names, contact details, legal representatives, the nature of the subcontracted work or services, and the percentage share of the subcontracting. The tender documents also require the bidder to confirm that the bid follows the prescribed price form structure, that all costs needed for proper performance are included, and that the bidder has reviewed the work description, annexes and clarifications and inspected the site with due care.
