Compliance requirements
The bidder must confirm that neither the bidder nor its management or supervisory body members, procurist or other authorised representative has been convicted under Section 95(1) of the Public Procurement Act of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, enabling the unlawful employment of a foreign national, use of child labour or human trafficking. The bidder must not have outstanding taxes, payments, environmental charges or social security contributions, and awarding the contract must not breach an international or government sanction. Bankruptcy, liquidation or other insolvency proceedings, local tax debt at the contracting authority’s location and convictions for tax offences are also addressed. A bidder registered outside Estonia must submit, with its tender, relevant criminal-record or equivalent documents and a certificate from the competent authority proving the absence of the grounds referred to in Section 95(1), points 1–4. The bidder must confirm that it will not use, for more than 10% of the contract value, subcontractors or suppliers covered by sanctions or originating from or controlled by Russia, and will not use a subcontractor who would have to be replaced under the law. First-tier subcontractors will be checked and must submit a European Single Procurement Document and confirmation that no exclusion grounds apply.
Qualification criteria and exclusion grounds
The bidder’s net turnover in each of the three financial years completed by the start of the tender must be at least EUR 4,000,000. The bidder must hold valid professional liability insurance with minimum coverage of EUR 1,000,000 and submit a copy of the policy or other evidence of the necessary financial means.
During the 60 months preceding the start of the procurement, the bidder must have completed at least three similar livestock-building construction projects as the main contractor, each with a minimum area of 2,500 m². The works must have been properly completed, an occupancy permit issued and the works accepted by the client. The bidder must provide reference-contract details, including the client’s name and contact details, contract subject, period, volume and, where possible, the procurement reference number; the contracting authority may request client confirmations.
During the same 60-month period, the bidder must have completed at least two design contracts for similar livestock buildings with a minimum area of 2,500 m² each. The design works must have been completed and accepted by the client, and equivalent reference details and, where required, client confirmations must be provided.
The works must be carried out with at least one construction works project manager holding at least a Level 7 Chartered Construction Engineer qualification specialising in general construction and/or building construction, or an equivalent qualification. The project manager must have completed at least two similar building projects during the last 60 months, each with a minimum area of 2,000 m². At least one construction site manager must hold at least a Level 6 Construction Engineer qualification or equivalent and have experience from two similar building projects completed during the last 60 months, each with a minimum area of 1,500 m². The design works project manager must hold at least a Level 7 Chartered Construction Engineer qualification or equivalent and have experience from at least one similar building project completed during the last 60 months with a minimum area of 1,500 m². For each responsible person, the bidder must provide the qualification certificate number and project-by-project experience details. If the bidder relies on another entity’s resources, that entity must participate directly in contract performance at least to the extent relied upon and, upon request, provide written consent to perform or arrange a substantial part of the works.
The tender must include a work schedule with interim deadlines, a technical document containing the technical specifications of all proposed equipment, and the detailed price form. Conditional tenders are not permitted. Where necessary, equivalence must be explained and supporting evidence submitted. Joint bidders must appoint an authorised representative and include a power of attorney. The bidder must attend the guided site visit arranged by the contracting authority before submitting the tender.
