Compliance requirements
The tender documents include mandatory exclusion grounds based on criminal organisation participation, corruption and fraud. A bidder or its management/representation persons must not have a final conviction for these offences within the last five years, unless the conviction no longer triggers exclusion under the applicable rules.
If an exclusion ground applies, the bidder may submit evidence of self-cleaning where allowed. The notice also states that bidders established in the Russian Federation or the Republic of Belarus are not allowed to participate, and the same restriction applies to any person whose qualification the bidder relies on under the procurement rules.
Qualification criteria and exclusion grounds
The bidder must have provided at least 2 maintenance service contracts for buildings with a closed net floor area of over 1,000 m² during the 36 months before the notice was published. The references must cover the maintenance activities listed under EVS 807 codes 240 and 250 and must have been performed under concluded contracts and in accordance with good practice.
The bidder must submit contract details in the ESPD: a list of contracts with the names and contact details of the contract partners, the project address and the contract period. If the contracts were awarded through public procurement, the procurement reference number must also be provided. On request, the bidder must provide a confirmation letter from the previous client stating that the services were performed properly and to the required extent.
The bidder must involve a project manager with at least secondary education and either an Estonian Chamber of Real Estate Maintenance qualification at level 5 ("Property Manager, level 5" or equivalent, or "Property Maintenance Master, level 5" or equivalent) or at least 3 years of experience, during which the person has managed maintenance works for at least two buildings with a closed net floor area of over 1,000 m², with each assignment lasting at least 6 months.
For all involved specialists, the bidder must provide the data required in Form 4 and an education certificate. If the professional certificate was issued in Estonia, the contracting authority will verify it in the public professional register and no document needs to be submitted. If the certificate or other proof of professional qualification was issued outside Estonia, the bidder must submit the document issued by the competent foreign body and a document from the competent Estonian authority confirming equivalence to the required qualification.
The bid must comply with all tender document requirements. The bidder must submit Form 2, Form 3 and Form 4, and if equivalent solutions are used, the bidder must explain them and provide evidence of equivalence.
