Compliance requirements

A bidder will be excluded if the bidder, or a member of its administrative, management or supervisory body, its procurator, or another person authorised to represent or control it, has been convicted of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering, unlawful employment or breaches of foreign workers’ employment conditions, illegal child labour or trafficking in human beings. Exclusion also applies in the event of unpaid state taxes, duties or environmental charges, unpaid tax or social security contributions, or an international or national sanction preventing the conclusion of the contract. The bidder must confirm that none of the exclusion grounds apply. In a joint bid, each joint bidder must provide a separate confirmation; the same applies to any entity whose economic, financial, technical or professional capacity is relied upon. The bidder must also confirm that it is entitled to participate in the procurement in view of any restriction imposed by the contracting authority based on the bidder’s place of establishment or residence. The offered goods must not be subject to international sanctions or originate from a sanctioned region. The bidder and persons acting on its behalf must also confirm that no corrupt acts have been committed in this procurement procedure.

Qualification criteria and exclusion grounds

Within the 36 months preceding the start of the procurement, the bidder must have completed at least one sales contract for an RFID-based self-service device used in a library and at least one sales contract including a self-service device hardware and software solution. Both conditions may be demonstrated through one or two contracts. The bidder must submit a list of the contracts, including descriptions, completion dates, the other contracting party’s contact details and, for public contracts, the reference number. The contracting authority may request additional evidence or explanations, which must be provided within three working days. The contract must be performed with an IT specialist who has experience from at least one project integrating self-service software with a library system using the SIP2 protocol and/or an API. The specialist’s CV must be submitted no later than five working days after the contract is signed and must demonstrate the required experience. The bid must include the fully completed technical compliance form in Annex 2, together with the manufacturer’s specifications and, where necessary, other manufacturer documents. The form may not contain blank fields, amendments or additional conditions. The proposed returns machine, including its components and software solutions, must comply with the technical specification. The bid must comply with all tender documents and may not be conditional. The price must be submitted in the required structure in euros to two decimal places and must include all costs necessary for proper contract performance. Zero or negative prices are not permitted. If an equivalent solution is offered, its equivalence and supporting evidence must be explained in the bid. In a joint bid, a power of attorney must be submitted.
