Compliance requirements

The bidder must not be subject to the exclusion grounds listed in Section 95(1)(1)–(5) and Section 95(4)(12) of the Estonian Public Procurement Act. The bidder must confirm this in the public procurement register. If there are other persons in the bidder’s company who are authorised to represent the company, make decisions on its behalf or control it, and these persons are not visible to the contracting authority from the commercial register card, the bidder must provide the name and personal identification code of the authorised person or confirm that no such persons exist. The bidder must also confirm compliance with the sanctions requirements: it may not involve subcontractors or suppliers, or rely on the capabilities of such companies for more than 10% of the contract value, if those companies are Russian citizens, residents or companies established in the Russian Federation, are more than 50% owned by such persons or entities, or act on their instructions. The bidder must also confirm that the offered goods are not the subject of international sanctions and do not originate from sanctioned areas.

Qualification criteria and exclusion grounds

The bidder must have a total net turnover from its last three completed financial years of at least EUR 200,000 in each year. The bidder must enter the turnover data for the last three completed financial years in the public procurement register. If the financial year does not run from 1 January to 31 December, the turnover data must be given for the bidder’s own financial year periods. On request, if the data are not available from a public register, the bidder must submit the annual reports for the last three financial years or extracts from them. For lot-specific turnover requirements, the highest required turnover applies; the turnover requirements for different lots are not added together. If the bidder relies on another company’s resources to prove turnover compliance, it must submit the other company’s consent in the form required by Appendix 5. The other company must state how much of its turnover the bidder may rely on, confirm that it will provide financial resources if needed during contract performance, and confirm joint responsibility for proper performance of the contract. If joint bidders rely on each other’s resources, the bid must also state the size and nature of the part of the contract performed by each joint bidder. The notice also requires that the bidder submit the documents needed to prove the turnover of any foreign company involved in the bid, if applicable.
