Compliance requirements
The contracting authority will exclude a bidder if any of the following grounds apply: a criminal conviction of the bidder or its management/representative for participation in a criminal organisation, breach of integrity duties, corruption, fraud, a terrorist offence or related incitement/assistance/attempt, money laundering or terrorist financing; tax, fee or environmental charge arrears; or the bidder or its management body being subject to an international sanction. The bidder must confirm that these exclusion grounds do not apply to itself, to a co-bidder in a joint bid, or to another entity whose resources it relies on.
Qualification criteria and exclusion grounds
The bidder must have, within the 60 months before the start of the procurement, performed as a main contractor similar design and construction works in a proper manner. Similar works mean the design and construction of at least one warehouse, accommodation building (including a barracks), public building or office building with a closed net floor area of at least 1,500 m2. If design was a separate contract, it must have covered at least the working design stage.
For the low-voltage works, the bidder, a joint bidder or a subcontractor must hold a state secret processing clearance issued by the Estonian Internal Security Service at CONFIDENTIAL level or higher, and a compliance certificate for the processing system issued by the Foreign Intelligence Service at CONFIDENTIAL level or higher. If the clearance or certificate expires during the procedure or contract term, a new application must be submitted in time so that access does not lapse.
The bidder must involve responsible persons with valid professional certificates in at least the following roles: chief project manager, design manager, site manager, responsible person for low-voltage works, and responsible person for the design of high-voltage parts. The required qualifications include, among others, a certified civil engineer level 7 or higher with specialisation in building construction and competence in construction management or design management, a civil engineer level 6 or higher with competence in construction management, a security systems designer level 6 with competence in alarm systems, surveillance systems and fire alarm systems design, and an electrical area A-competence certificate or a certified electrical engineer level 7 with competence in electrical installations design. The person responsible for low-voltage works must also have a state secret access clearance at CONFIDENTIAL level or higher by the time the contract is signed.
If the bidder relies on another entity’s resources, it must submit that entity’s written and signed consent, together with the responsible persons’ details and the validity information of the access clearances in the form required by the tender documents.
