Construction of the Tohvri Pellet Boiler Plant

Compliance requirements

The bidder must not be subject to exclusion grounds relating to participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or the illegal use of child labour or other forms of human trafficking. The checks cover the bidder and its management, administrative and supervisory body members, procurists and other persons authorised to represent or control it during the last five years. The bidder must also have no outstanding tax or social security payment obligations. The notice states that tax debt below EUR 100 or tax debt subject to a payment schedule is not shown on the tax debt certificate. The bidder must confirm that entering into the contract would not breach international or Estonian sanctions and that it is not subject to exclusion under the Public Procurement Act. Where applicable, the bidder may provide evidence of remedial measures demonstrating restored reliability. The bidder must also confirm that it will not use a subcontractor who would have to be replaced under section 122(7) of the Public Procurement Act.

Qualification criteria and exclusion grounds

The bidder’s average net turnover over the last three completed financial years must be at least EUR 100,000. If the company has operated for fewer than three financial years, the average is calculated over the years in which it operated. During the last five years, the bidder must have completed at least two construction contracts properly and with acceptance by the client. Each contract must have concerned the construction of an automatically operated and remotely controllable pellet boiler plant with an input capacity of at least 150 kW, or a technologically similar boiler plant, such as a wood-chip boiler plant. The list of works must include the object name and location, a description of the works including the boiler system type, fuel and input capacity, the contract value, start and end dates, and the client’s and contact person’s details. At the contracting authority’s request, the bidder must provide client confirmations that the contracts were properly completed, including the technical characteristics and performance period. If relying on another company’s capacity, the bidder must submit that company’s written consent, identify the resources and indicators relied upon, and provide confirmation of its direct participation in the relevant part of the contract. The tender must comply with all tender document requirements; conditional tenders are not permitted. The required price list must be submitted in the structure specified in the tender documents. Before submitting the tender, the bidder must inspect the site at Tohvri Care Centre in Hindu village and include the site-visit record. In a joint tender, a power of attorney for the joint tenderers must be provided. The bidder must describe any trade secrets and justify their classification, or confirm that the tender contains no trade secrets; the tender price may not be classified as a trade secret.
