Compliance requirements
The exclusion grounds cover the usual criminal conviction grounds and other grounds laid down by law, including participation in a criminal organisation, corruption, fraud, and offences related to terrorist acts or terrorist activities. In the ESPD, the bidder must also confirm that it is not subject to sanctions and that it does not use prohibited subcontractors or suppliers for contract performance. If an exclusion ground applies, the bidder may in certain cases submit evidence of self-cleaning, but the exact conditions must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be entered in the commercial register. To provide the service, the bidder must hold a valid community licence for passenger transport by bus, and the contracting authority will verify its validity using the public data of the economic activities register. For technical and professional ability, the bidder must have performed at least one similar passenger transport contract during the 36 months preceding the start of the procurement. The exact evidence, forms and data must be submitted in accordance with the ESPD and the tender requirements. The bid must also include the completed list of vehicles to be used for contract performance.
