Compliance requirements
The bidder must confirm that neither the bidder nor its representatives or members of its management or supervisory bodies has been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or illegal use of child labour or human trafficking. Grounds for exclusion may also include tax or social security debt, breaches of environmental, social or labour-law obligations, bankruptcy or another insolvency situation, assets administered by a liquidator or court, suspended business activities, serious professional misconduct, anti-competitive agreements, conflicts of interest, serious or repeated breaches of previous procurement contracts or early termination, and the submission of false information or failure to provide required documents. The notice also covers international sanctions, enabling an unlawfully staying foreign national to work, tax offences, local tax debt owed in the contracting authority’s location, and restrictions on the right to submit a tender. The bidder must confirm that it will not use a subcontractor subject to an exclusion ground or requiring replacement. For first-tier subcontractors, the bidder must provide the required information and a signed declaration from each subcontractor confirming that the exclusion grounds under Section 95(1), points 1–5, do not apply. The contracting authority may request additional evidence, and failure to replace a subcontractor when required may lead to rejection of the tender.
Qualification criteria and exclusion grounds
The bidder’s net turnover must have been at least EUR 12,000,000 in each of the last three financial years completed before the start of the procurement procedure. Where the financial year follows the calendar year, the relevant years are 2023, 2024 and 2025. The contracting authority may request an extract from the annual accounts or other evidence confirming the turnover.
Within the 60 months preceding the start of the procurement procedure, the bidder must have properly completed at least two similar construction contracts as the main contractor. At least one contract must have involved a building or building complex with an A or B energy rating. Each reference must concern a public or community-use building of at least 3,000 m² enclosed net floor area, such as an educational, cultural, sports, administrative, social-care or healthcare building, and must include construction or reconstruction of the load-bearing structures and external envelope, interiors, heat-recovery mechanical ventilation, heating, building automation, electrical and low-voltage systems. The bidder must provide reference descriptions, energy rating, floor area, contract dates, client contact details and, when requested, confirmation from the client that the works were properly completed. Additional explanations or documents may have to be submitted within five working days of the request.
The team must include a project manager with at least a level 7 diploma-level civil engineering qualification, specialising in building construction and construction activity management, or an equivalent qualification. The project manager must have at least five years of construction experience and, during the last 60 months, experience managing at least two similar construction projects involving buildings or building complexes of at least 3,000 m², including at least one A- or B-rated building. The site manager must have at least a level 6 civil engineering qualification in building construction and construction activity management, or a level 6 construction manager qualification in general building construction, or an equivalent qualification. The site manager must have at least five years of construction experience and, during the last 60 months, experience managing at least one similar project of at least 3,000 m². The BIM coordinator must have higher education in construction, at least five years of BIM experience and, during the last 60 months, experience creating and coordinating BIM as-built models for at least two similar buildings of at least 2,000 m². The project manager, site manager and BIM coordinator must be different individuals. The required CVs, signed consents and the BIM coordinator’s education evidence must be submitted; for qualifications issued outside Estonia, a copy of the relevant qualification document is required.
At the start of the procurement procedure, the bidder must hold a valid ISO 9001 quality management certificate and ISO 14001 environmental management certificate for construction activities, or equivalent confirmation from an independent audit firm or accredited certification body. The bidder must be ready to provide certificate copies and evidence of equivalence, and may not rely on another entity’s capacity for these requirements.
The tender must comply with all tender documents and must be unconditional. The price must be entered in the required price schedule and in Annex 2 in euros excluding VAT, with two decimal places, in Excel format. A site visit at the time set by the contracting authority is a prerequisite for submitting a tender. A power of attorney must be included for a joint tender. If subcontractors are used, Forms 3 and 3a must be submitted. Under the environmental conditions, furniture made of solid wood must use legally sourced timber with evidence provided on delivery; REACH candidate substances exceeding 0.1% by mass must be declared; dismantling and repair instructions must be supplied; a warranty of at least three years and spare-part availability for at least three years must be provided. The bidder must also confirm compliance with anti-corruption and sanctions restrictions and ensure that Russian-related subcontractors and suppliers do not account for more than 10% of the contract value.
