Compliance requirements

The bidder must confirm that neither it nor the members of its management, administrative or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning, if this is allowed in the procurement. The exact exclusion grounds and any possible evidence must be checked in the tender documents.

Qualification criteria and exclusion grounds

The bidder must have properly performed at least one contract in the 60 months before the start of the procurement whose subject was the provision of the same or similar service as this tender. A similar contract means a contract for checking the availability of tobacco products or alcoholic beverages, checking the availability of alcoholic beverages to minors or intoxicated persons, or checking the availability of other age-restricted products or services by the mystery shopping method or another purchase-behaviour simulation method, and during which compliance with legal sales restrictions was assessed. The bidder must submit the details of at least one such contract in the ESPD, including the contract name, description of the service performed, and the client’s name and contact details.
