Compliance requirements
The bidder and its management bodies must not have been finally convicted in the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activity, money laundering or terrorist financing. The bidder must also confirm that the tender is unconditional, that the offered goods are not subject to international sanctions, and that no subcontractor subject to replacement under the procurement rules will be used in performing the contract. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted by the procurement documents or the law.
Qualification criteria and exclusion grounds
The bidder must have at least one properly completed construction contract from the 60 months before the start of the procurement: 1) one contract under which at least two floating piers with a total length of at least 36 metres were built or reconstructed; and 2) one contract under which at least 700 m² of shoreline protection was built or reconstructed. The same contract may satisfy both requirements. The bidder must provide reference data in the ESPD, including the contract name, client name and contact details, description of the contract object and the contract performance period. If the contract was awarded through a public procurement procedure, the procurement reference number must also be provided. If the bidder relies on another entity's technical and professional capacity, that entity must participate in performing the contract to the extent relied on.
