Compliance requirements

The contracting authority applies the exclusion grounds under Section 72(7) of the Public Procurement Act. It will not award the contract to an economic operator if the operator, or a member of its administrative, management or supervisory body, or another legal or contractual representative connected with the procurement, is known to have an exclusion ground under Section 95(1). The authority checks exclusion grounds only if it knows or suspects that such a ground exists or may exist. The bidder must confirm whether any exclusion ground applies to the bidder or a related person.

Qualification criteria and exclusion grounds

The author of the design must have a higher education degree in fine arts, or applied higher education in landscape architecture, or higher education in architecture. Alternatively, the author must belong to the Estonian Artists’ Association or one of its sub-associations, the Estonian Association of Architects, the Estonian Association of Interior Architects, the Estonian Designers’ Association, the Estonian Landscape Architects’ Association, or an equivalent recognised professional association in another country. The artist or sculptor must cooperate with an architect or landscape architect when carrying out the work. The contracting authority may request additional documentary evidence to verify the submitted information. The participant must provide the author’s details in the required form and, where relevant, details of the cooperation partner or a statement that no cooperation obligation applies. If the participant is required under the laws of its country of establishment to be registered in the commercial register, it must submit a valid registration document; for an Estonian participant, the authority checks the data in the commercial register.
