Annual aircraft maintenance (Land and Spatial Board)

The bidder and its representatives must not have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or the use of child labour or human trafficking. Exclusion may also apply in cases of tax or social security debt, breaches of environmental, social or labour law, bankruptcy or another insolvency situation, suspended business activity, serious professional misconduct, anti-competitive agreements, a conflict of interest, involvement in preparing the procurement procedure, serious breaches of previous public contracts, or the submission of false information or failure to provide required documents. Contracting with the bidder must also not breach international or Estonian sanctions or other statutory exclusion grounds. Where an exclusion ground applies, the bidder may provide evidence of remedial measures restoring its reliability where that option is available.

The bidder’s total turnover in the contract-related field for the last three financial years completed before the commencement of the procurement must be at least EUR 100,000. Initially, compliance must be confirmed in the single procurement document and the turnover for the three years may be stated there; the contracting authority may request extracts from the annual reports, unless the data of an Estonian bidder is publicly available in a database. The bidder must hold, or be able to obtain, valid professional liability insurance of at least EUR 1,600,000. A confirmation of this must be provided in the single procurement document. The bidder must have a team responsible for carrying out the maintenance work. Team members must hold a valid aircraft maintenance technician licence issued by the Estonian Transport Administration or an equivalent authority in the bidder’s country of establishment, proving qualification for the Land and Spatial Board’s aircraft type. Copies of the relevant licences must be submitted with the bid. The bid must include information about the destination airfield to which the aircraft will be transported for annual maintenance. The bid must comply with all conditions in the procurement documents and the draft contract; conditional bids are not permitted. The price must be submitted in the required structure. Where applicable, an explanation and evidence of equivalence must be included. For a joint bid, the bidders must appoint an authorised representative, submit a power of attorney, and provide a single procurement document for each joint bidder. The bidder must also provide the names and personal identification codes of management or authorised persons not visible in the public procurement register, or confirm that no such persons exist. During contract performance, only subcontractors and suppliers established in countries listed in Section 3(2) of the Public Procurement Act may be used, and persons or entities subject to Russian sanctions may not be engaged for more than 10% of the contract value. The bid must identify any trade secrets and explain their designation; the bid price may not be classified as a trade secret.
