Compliance requirements

A bidder, including each member of a joint bid where applicable, may be excluded if it is bankrupt, undergoing liquidation or insolvency proceedings, has suspended business activities or is otherwise in a comparable situation. Exclusion also applies where the bidder has outstanding state tax, payment, environmental charge or tax and social security contribution debts, unless the debt has been paid or rescheduled, or is paid or rescheduled within 10 calendar days after notification. The bidder must confirm that the exclusion grounds under the applicable provisions of the Public Procurement Act do not apply. The average salary of the bidder’s employees during the six-month reference period must not have been below 70% of the average salary in the relevant field; this does not apply where the bidder has no employees. Foreign bidders must provide equivalent evidence from the competent authority in their country. The bidder must also confirm that it is not a related person to the technical consultant advising the beneficiary on the apartment building’s reconstruction. If the grounds cannot be verified through public registers, requested evidence must be submitted within 10 calendar days, otherwise the bidder will be excluded.

Qualification criteria and exclusion grounds

The bidder must be registered for construction activities in the economic activities register in areas covering general construction, indoor climate systems, and internal or associated water supply and sewage systems. Where electrical works are performed, registration for the construction and installation of electrical installations is required. A foreign bidder may provide equivalent evidence of professional competence. The bidder’s net turnover in the financial year preceding submission of the bid must be at least twice the estimated VAT-exclusive value of the contract. The input does not provide the estimated contract value or the resulting specific turnover amount. The bidder must be able to provide, by the date of signing the construction contract at the latest, a first-demand construction-period bank, financial institution or insurance guarantee equal to 5% of the VAT-exclusive contract value. If provided after contract signature, the guarantee must be submitted within 10 calendar days and remain valid throughout the construction period. Depositing an equivalent amount in the beneficiary’s or a notary’s account is also permitted. During the 60 months preceding commencement of the procurement, the bidder must have completed at least one equivalent construction project as the main contractor, with a value of at least half the estimated VAT-exclusive contract value. The project must have involved construction, extension or full reconstruction of a building and included construction or reconstruction of load-bearing structures and external envelopes, heat-recovery mechanical ventilation, and a new heating system. The bidder must provide the project details, period and value, together with either a reference to the relevant building register occupancy notice or use permit, or a handover and acceptance certificate signed by the client and contractor. The team must include a project manager holding at least a level 6 building engineer qualification or an equivalent level 6 construction manager qualification; a site manager holding at least a level 5 construction site manager qualification; a heating, ventilation and cooling systems specialist holding at least a relevant level 6 qualification; a water supply and sewage systems specialist holding at least a relevant level 6 engineering or equivalent construction manager qualification; and, where electrical works are performed, a person holding at least a class B competency certificate or a level 6 electrical engineer qualification for consumer electrical installations. The bidder must provide each person’s name and certificate number. If another person’s qualifications are relied upon, that person’s signed commitment to participate must be submitted. A level 7 authorised architect, or a person with equivalent foreign qualifications, must be responsible for the project’s compliance with the principles of the European New Bauhaus. The bidder must have a construction-sector quality management system meeting EVS-EN ISO 9001 and an environmental management system meeting EVS-EN ISO 14001, or equivalent documentation, and provide the relevant evidence.
