Compliance requirements
The exclusion grounds include at least participation in a criminal organisation, corruption, fraud and the other grounds listed in the ESPD. The bidder must answer these as yes/no questions and, where relevant, provide explanations, dates, reasons, persons involved, the duration of exclusion and evidence of self-cleaning measures. If an exclusion ground applies, the bidder may submit evidence of remediation where this is allowed for the procurement. The exact list of exclusion grounds must be checked in the ESPD and the tender documents.
Qualification criteria and exclusion grounds
The bidder must have the required authorisation to carry out the relevant activity in its country of establishment, if such authorisation, registration in a professional or commercial register, or membership in a relevant organisation is required by law. If applicable, the bidder must provide a certificate of registration, authorisation or membership, unless the information is freely available in an electronic database; in that case, the bid must include the database link.
The bidder’s average annual turnover in the rail rolling stock sector must have been at least EUR 100,000,000 in each of the last 3 financial years before the start of the procurement. The turnover must come from the design, production, supply, delivery and maintenance of rail rolling stock and its components. To prove compliance, the bidder must provide a breakdown showing turnover from the specified field for each year and, where relevant, the InforEuro exchange rate used for conversion to euros.
The bidder must submit the technical documents listed in the tender documents, including the general layout, drawings and cross-sections of the rolling stock unit, door arrangement scheme, front view, seat layout plans and other technical documents required in the instructions to bidders. If the bidder wants to receive points under the award methodology, the documents required for the scoring criteria must also be submitted.
If the bidder relies on another operator’s resources to meet the qualification requirements, the relevant form signed by all involved operators must be submitted, and a power of attorney must be attached if the signatory is an authorised representative.
If the tender is a joint tender, the joint tenderers’ form signed by all joint tenderers must be submitted, and a power of attorney must be attached if the signatory is an authorised representative.
The bidder must submit the key experts’ CV form proving compliance with the requirements set out in Annex 6, together with a confirmation that there is no conflict of interest.
The bidder must submit the cost and additional points form, the list and purchase price of post-maintenance spare parts, and the special equipment set and purchase price. The bidder must also confirm that the offered rolling stock is not subject to international sanctions, does not originate from sanctioned territories, does not pose a threat to the national security of Estonia, Latvia or Lithuania, and is free from any legal, technical or supply-chain dependency arising from sanctions that would make performance unlawful. On request, the bidder must provide all documents and data needed to verify this condition.
