Compliance requirements
The bidder must confirm that neither it nor its representatives or management and supervisory board members have been finally convicted during the last five years of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, child labour or human trafficking. There must also be no outstanding tax or social security debt, bankruptcy, liquidation or other insolvency proceedings, arrangement with creditors, administration of assets by a liquidator or court, or suspended business activities.
The exclusion grounds also cover breaches of environmental, social and labour law, serious professional misconduct, agreements restricting competition, conflicts of interest, involvement in preparing the procurement, serious breaches of previous contracts, and the submission of false information or failure to provide required documents. They also include enabling an unlawfully residing foreign national to work, being subject to international sanctions, owing local taxes in the contracting authority’s area, and having been convicted of tax offences.
The bidder must confirm that its registered office or residence is not in the Russian Federation or Belarus. It must also not involve, for more than 10% of the contract value, subcontractors, suppliers or relied-upon entities covered by the specified Russian sanctions restrictions. First-tier subcontractors will be checked and must submit a European Single Procurement Document. Where an exclusion ground applies, evidence of remedial measures may be submitted where permitted by the tender documents.
