Compliance requirements
The tenderer must not be subject to exclusion grounds, including a final conviction within the last five years, or an ongoing exclusion period, for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, or illegal use of child labour or human trafficking. Compliance with tax and social security payment obligations will also be checked. The threshold stated in the notice is EUR 100; an officially deferred tax debt may be treated differently under the applicable rules. In addition, awarding the contract must not breach an international or Estonian sanction, and the tenderer must not have breached obligations relating to employing a foreign national without a lawful basis. The tenderer must provide the declarations required in the ESPD and, where applicable, evidence concerning exclusion grounds. Where permitted, the tenderer may describe remedial measures taken to restore its reliability.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise financial capacity requirements, previous experience requirements, team requirements, or specific registration and certification requirements; these must be checked in the tender documents. Under the compliance requirements, the tenderer must submit a tender accepting all conditions set out in the tender documents, and conditional tenders are not permitted. The tender price must follow the prescribed pricing structure. If the tender proposes an alternative to a solution referred to in the tender documents, the tenderer must explain its equivalence and provide supporting evidence. In a joint tender, a power of attorney for the authorised representative of the joint tenderers must be submitted. The tenderer must identify any information claimed as a trade secret and justify that designation; the tender price and other indicators relating to the evaluation of works and supplies may not be classified as trade secrets.
