Compliance requirements

The bidder must confirm that none of the exclusion grounds listed in Section 95(1) points 1–5 of the Public Procurement Act apply. A foreign bidder must provide a criminal record certificate or an equivalent document showing the absence of the circumstances referred to in points 1–3, and a certificate from the competent authority in its country of establishment showing the absence of the circumstance referred to in point 4. The bidder must also confirm that it is not restricted from submitting a tender or request because of its place of establishment or residence, if the contracting authority has imposed such a restriction in the tender documents.

Qualification criteria and exclusion grounds

The bidder must demonstrate financial and technical capacity. For Lot 1, the total turnover for each of the last three completed financial years must be at least EUR 250,000, and within the last 36 months the bidder must have completed at least 1 sales contract for special and heavy machinery goods with a total value of at least EUR 100,000 excluding VAT. For Lot 2, the total turnover for each of the last three completed financial years must be at least EUR 150,000, and within the last 36 months the bidder must have completed at least 1 sales contract for passenger cars and trailers goods with a total value of at least EUR 50,000 excluding VAT. For both lots, the bidder must provide the contract details, contract value, date of conclusion and information about the other contracting party; a continuing contract is allowed if the required quantity or value has actually been sold under it. In addition, for both Lot 1 and Lot 2 there must be a sales office and/or warehouse within a maximum of 50 km from the contracting authority’s location at Väike-Sõjamäe 2, Tallinn, measured by drivable road distance, and the bidder must confirm that the contracting authority can collect goods on site and make purchases there. The bidder must appoint a person responsible for performance of the framework agreement, who acts as the bidder’s contact person and manager and whose Estonian language skills are at least B2; before contract award or when contact details change, the bidder must provide the person’s name, phone number and email address. The bidder must also have a web-based ordering system that does not create additional costs for the contracting authority, and must confirm that it complies with subsection 4.3 of the technical specification. The bid must comply with all tender document requirements, be submitted in the required structure, and equivalent solutions must be supported by evidence where necessary.
